In consideration of my/the minor participant’s participation in the Kettlebell Kountdown Elimination Race (the “Event”) and of you accepting this entry, I, the participant and/or on behalf of the minor participant and intending to be legally bound do hereby waive and/or forever release any and all rights and claims for damages or injuries that I/the minor participant may have against the Event Director, UltraSignup.com, the Kettlebell Kountdown Elimination Race Event, the City of Pelham, Oak Mountain State Park, The Running Birds LLC and all of their agents, sponsors, officials, volunteers, representatives and employees (the “Releasees”) for any and all injuries to me/the minor participant and/or any and all damage to my/the minor participant’s personal property and/or from all claims or liabilities of any kind arising out of my/the minor participant’s participation in this Event, even though that liability may arise out of negligence or carelessness on the part of the Releasees.  This release includes all injuries and/or damages suffered by me/the minor participant before, during or after the Event.  I recognize, intend, and understand that this release is binding on my and/or the minor participant’s heirs, executors, administrators, or assignees.
I know that running a road/trail race is a potentially hazardous activity.  I/the minor participant should not enter and run unless I/the minor participant am/is medically able to do so and properly trained. I, on behalf of myself and/or the minor participant, assume all risks associated with running in this Event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I/the minor participant might have based on any of those and other risks typically found in running a road/trail race.  I, on behalf of myself and/or the minor participant, acknowledge all such risks are known and understood by me. I, on behalf of myself and/or the minor participant, agree to abide by all decisions of any race official relative to my ability to safely complete the Event.  I, on behalf of myself and/or the minor participant, certify as a material condition to my/the minor participant being permitted to enter this race that I/the minor participant am/is physically fit and sufficiently trained for the completion of this Event and that a licensed medical doctor has verified my physical condition.
In the event of an illness, accident, injury, or medical emergency arising during the Event I, on behalf of myself and/or the minor participant, hereby authorize and give my consent to the Event Director to secure any treatment deemed necessary for my/the minor participant’s immediate care from any accredited hospital, clinic and/or physician.  I, on behalf of myself and/or the minor participant, agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me/the minor participant including but not limited to medical transport, medications, treatment, and hospitalization. I, on behalf of myself and/or the minor participant, agree the Releasees are not liable for any accidents, injuries, medical emergencies, or illnesses before, during or after the Event. 
As it applies to my/the minor participant’s participation in this Event, I, on behalf of myself and/or the minor participant, agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov.  I, on behalf of myself and/or the minor participant, also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community, or by this race for my participation in this race.
Further, I, on behalf of myself and/or the minor participant, grant permission to the Releasees to use my/the minor participant’s name, voice, and images of myself/the minor participant in any photographs, motion pictures, results, publications, or any other print, videographic, or electronic recording of this Event for legitimate purposes.
This Event follows the standard running industry policy: All Event entry fees are non-refundable.  We reserve the right to postpone or cancel the Event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff.  No refunds will be issued under these circumstances.  We reserve the right to change the details of the Event without prior notice.  I, on behalf of myself and/or the minor participant, understand that the Event entry fee is non-refundable and bib numbers are non-transferable.
THIS IS A RELEASE OF LIABILITY. By submitting this entry, I acknowledge having read and agreed to the above release and waiver including the no refund policy on behalf of myself and/or the minor participant. By signing this waiver without a parent or legal guardian’s approval below, I acknowledge that I am at least 18 years of age. No oral representations, statements, or inducements, apart from the foregoing written provisions, have been made to me by the Released Parties or by any third party prior to or in consideration of the execution of this Release.
